Managing Partner
Over a decade ago, Wesley Mussio decided to expand his legal expertise into the area of estate litigation and has been increasing his prominence in the field of estate litigation in British Columbia ever sense.
Wes Mussio was the trial lawyer on one of the leading cases involving testamentary capacity which was successful in that his clients were able to defeat a will that disinherited them by arguing the testator did not have legal capacity to enter into the will (Laszlo v. Lawton 2013 BCSC 305).
Wesley Mussio has also appeared as lead counsel in more than a dozen cases involving a wills variation dispute. The most recent success is Sharma vs Sharma Estate 2016 BCSC 1397 where two of three adult children were disinherited by their mother. The court reversed the Will such that all three adult children received one third of the estate each.
Over the last several years, Mr. Mussio and his legal team at Mussio Goodman (formally Mussio Law Group) have run a large number of estate litigation files, most of which have been successfully settled without extensive litigation.
Wes Mussio is a strong advocate of the mediation process and always works to achieve a settlement out of court for his clients. However, having acted as lead counsel in a large number of estate litigation trials, Mr. Mussio is always prepared to take a claim to court in the event that the family members are unable to reach an out-of-court solution.
